How many days off do I get for moving house?
Are you about to move house, but don’t know if your job entitles you to any days off? You’ve come to the right place.
At SIT Spain we want to clear up a doubt that many people have when moving house, as it is an experience that requires time and, on occasion, a bit of stress.
It’s definite: you’re moving.
You have to get out of there as soon as possible, sometimes they are small and relatively easy moves, but other times you have to transport large and heavy objects and take an entire house with your belongings of many years.
You may be very organised and have already made some progress with personal belongings or things that are not too heavy, but you still need a whole day to move everything important, whether you hire a professional removal company or not, you will certainly have to be present even if it is only to receive them in the new flat or to supervise.
Well, during the year 2023, according to the provisions of article 37 of the Workers’ Statute, you are entitled to one paid day off for moving and the company is obliged to pay for this day as a working day.
But…
When do I have to notify my employer and do I have to provide proof?
We tell you all about it:
The Workers’ Statute
According to the provisions of Article 37 of the Workers’ Statute, paragraph 3.c, “The worker, with prior notice and justification, may be absent from work, with the right to remuneration, for any of the following reasons and for the following period of time: One day for moving from the usual place of residence”.
As it says, any worker has the right to one day off as long as it is a move from the usual residence, it does not distinguish between moving to another city or within the same city, but it is important that it is the usual one.
When do I have to give my employer notice?
“There is no notice period in the statute for requesting days off for moving, but for professional ethics it is advisable to give as much notice as possible, at least 15 days.
Am I asked to provide proof?
Even if you have a very close relationship with your boss, the best thing to do is always to leave this day off justified, but which paper is the proof?
The certificate of census registration that proves that you have moved there, which you can obtain from the local town hall.
As we have said, it is best to give plenty of notice so that the company and, above all, your colleagues can plan ahead and continue with work activities in your absence.
And finally:
Do I have to fulfil certain conditions?
Apart from the indispensable requirement that your move must be to your habitual residence, no other conditions are necessary. So stop worrying and start planning your move as soon as possible.
